Personal Data Notice and Consent Form for Customers


1. Collection of Personal Data

This Notice is issued pursuant to the Personal Data Protection Act 2010. The main purpose of this notice is to make you better understand the reasons and purposes of the collection of personal data by the Company as well as the Company’s commitment to ensure that your data is securely processed and kept. We believe that our customers have an expectation to understand how their personal data is handled. It is part of our Company's values that all personal data and privacy of our customers are treated with care and respect. The security of your personal data is important to us.

The company and the DKSH Group treats your Personal Data seriously. In connection with your commercial dealings with the Company and its Group, it is necessary for you to provide us data about yourself and/or your business entity. If you provide us with any personal data to a third party (e.g. employees, business partners, other owners), by submitting such personal data to us, you represent to us that you have obtained the consent of the third party to provide us with their personal data for the purposes described in this notice.


2. Nature of Personal Data

The Personal Data in relation to you may include copies and other details of identity documents, proof of address and other contact details, information concerning age, address, telephone number, contact person, position, estimated total turnover per annum, types of goods/services requested, salesman/collection name and number, business registration number, authorized capital, paid-up capital, name, NRIC no. and home address of proprietor/partners/directors, supplier’s name, average monthly purchases, average payment days, period of dealing, credit terms and credit limit, fixed assets owned and approximate value; description of business premises.

The above description of personal data is merely a general description of the various types of personal data that we collect from various customers. The nature of personal data differs from customers to customers. Depending on the nature of business and circumstances, we may only need to collect and process a more limited form of personal data from them. In other situations, there may be a need to collect more personal data for the nature of transaction and business. We do not believe in collecting excessive personal data and what we collect are the essentials that are required to ensure the efficacy of business and transactions.


3. Source of Data

Generally, the personal data that we collect comes directly from you and/or your business.

Apart from information provided by you, the Company and its Group may obtain Personal Data on you, your business entity (including shareholders, directors, etc) from various reference checks, backgrounds checks or from the various governmental authorities.

The Company and its Group will continue to obtain your Personal Data as long as there is a business relationship between you and the Company and its Group.


4. Importance of Providing Personal Data

We would like you to understand that it is important for you to provide the necessary personal data to us for the purpose of operating the necessary and existing business arrangements between you and DKSH.

Failure to supply such Personal Data will affect our ability to enter into commercial dealings with you and/or your company.


5. Processing of Personal Data

Personal Data you provide will be collected, used and otherwise processed by the Company and/or its Group for the following purposes:

a. to consider your credit account application

b. to ascertain your credit worthiness

c. user or customer relationship management procedures

d. the delivery of services or products and the marketing of such services or products whether present or future, to you

e. those purposes specifically provided for any particular service or product offered by us

f. conducting marketing and client profiling activities in connection with our services and related products

g. credit assessments and other background checks as we may determine to be necessary or appropriate

h. our internal record keeping

i. collection of outstanding payments

j. prevention of crime (including but not limited to fraud, money-laundering, bribery)

k. meeting any legal or regulatory requirements relating to our provision of services and products and to make disclosure under the requirements of any applicable law, regulation, direction, court order, by-law, guideline, circular, code applicable to us or any member companies of our Group

l. purposes relating to any of the above (including but not limited to research, benchmarking and statistical analysis); and/or

m. enforcing our legal rights

n. research, benchmarking and statistical analysis and/or

o. other reasons that are permitted under the Personal Data Protection Act 2010 or applicable laws


6. Disclosure

We treat the confidentiality of your personal data very seriously, which is of utmost importance to us. Personal Data provided to the Company by you will be kept confidential. However, in certain circumstances, it would be necessary for us to provide or disclose your personal data for the purposes stated above to the following categories of persons:

a. any body or person to whom the Company is compelled or required to do so under law or in response to a competent or government agency;

b. any person where public interest or our interests require disclosure, as permitted by law;

c. such sub-contractors or third-party service or product providers as the Company may determine to be necessary or appropriate;

d. the Company’s suppliers and product principals (strictly for the purpose of market analysis and benchmarking to understand the needs to the customers better).

In addition, where we consider it necessary or appropriate for the purposes of the conduct of business, data storage or processing or customer / human resource management, we may transfer your Personal Data to another member of the Group or third party service or product providers within or outside the country in which the Company is established, under strict conditions of confidentiality and similar levels of security safeguards.

We merely disclose data that is necessary for the reason of such disclosure. This means that we only deliver the narrowest possible set of information that is necessary for the purpose of disclosure.


7. Safeguards

We shall endeavor to implement the appropriate administrative and security safeguards and procedures in accordance with the applicable laws and regulations to prevent the unauthorized or unlawful processing of your Personal Data and the accidental loss or destruction of, or damage to, your Personal Data.


8. Data transfer and sharing

Where we consider it necessary or appropriate for the purposes of data storage or processing or human resource management, we may transfer your Personal Data to another member of the Group or third-party service or product providers within or outside the country in which the Company is established, under conditions of confidentiality and similar levels of security safeguards.


9. Your Rights of Access and Correction

9.1 You have the right to request access to and correction of information about you held by the Company and you may:

a. check whether the Company holds or uses your Personal Data and request access to such data

b. request that the Company correct any of your Personal Data that is inaccurate, incomplete, or out-of-date

c. request that the Company specify or explain its policies and procedures in relation to data and types of Personal Data handled by the Company
