By submitting this Credit Application Form, you consent that the information and personal data contained in this form and updated from time to time may be used by DKSH to process your application for a credit account with DKSH. The nature of Information that may be required includes the information listed in this Form as well as information obtained from third party background checks.
Personal Information collected will be used and processed by DKSH for the following purposes:
a) to consider your credit account application
b) to ascertain your credit worthiness
c) user or customer relationship management procedures
d) the delivery of services or products and the marketing of such services or products whether present or future, to you
e) those purposes specifically provided for in any particular service or product offered by us
f ) conducting marketing and client profiling activities in connection with our services and related products
g) credit assessments and other background checks as we may determine to be necessary or appropriate
h) our internal record keeping
i) collection of outstanding payments
j) prevention of crime (including but not limited to fraud, money-laundering, bribery)
k) meeting any legal or regulatory requirements relating to our provision of services and products and to make disclosure under the requirements of any applicable law, regulation, direction, court order, by-law, guideline, circular, code applicable to us or any member companies of our Group
l) purposes relating to any of the above (including but not limited to research, benchmarking and statistical analysis)
In relation to the information that you have provided on your proprietor/partners/directors, details of their I/C no and home address, you hereby confirm that you have obtained the necessary consent from such persons to disclose their data to DKSH for the purpose of considering this application and that such persons agree that DKSH collect and process their data for the purpose of the commercial dealings between you and DKSH
Further, your personal data or information provided under this form may be transferred to any company within the DKSH’ Group which may involve sending my/our data to a location with and / or outside Malaysia
In addition, you agree that DKSH may at any time disclose to any third parties (including without limitation credit bureaus) any information, particulars or details provided by a member for the purpose of credit assessment, debt collection or any other purpose which DKSH in its sole and absolute discretion may decide.
DKSH may use and disclose your Information for the purposes specified above provided however, that DKSH may use and disclose your information pursuant to a judicial order, a lawful requirement of governmental agency, or by operation of law, but then only to the extent so ordered or permitted.
DKSH will ensure that your information is accurate and updated. That said, to ensure DKSH maintains accurate information, you are advised to furnish timely, accurate and complete information pertaining to you. Your information will be updated upon provision of such information from time to time.

I/We hereby agree to adhere to the terms & conditions set forth with; accept the credit facility herein given subject to the following terms and conditions:-
| i. | DKSH Malaysia Sdn Bhd reserves the right to change at the rate 1.5% per month or such rate on all overdue accounts as DKSH Malaysia Sdn Bhd shall from time to time notify us/me in writing; |
| ii. | Credit given here in is at DKSH Malaysia Sdn Bhd’s sole and absolute discretion. DKSH Malaysia Sdn Bhd reserves the right, without assigning any reasons thereto, to stop the credit/revert to cash dealings and/or withhold goods and services, suspend or terminate all present and future transactions with us/me; |
| iii. | We shall indemnify you against all legal fees and other expenses incurred by you in enforcing payment of outstanding balances, including any interests chargeable on overdue balances; |
| iv. | Goods sold and delivered by DKSH Malaysia Sdn Bhd shall be further governed by terms and conditions specified in the Delivery Order and/or Invoices; |
| v. | Acquiescence by DKSH Malaysia Sdn Bhd of or in any breach of any provisions herein or in the Delivery Order/Invoices shall not operate as or be deemed to be waiver of such provisions; |
| vi. | Credit Terms; Computed from Invoice date. |
| vii. | DKSH Malaysia Sdn Bhd is hereby authorized to conduct searches with any service provider as it deems fit to obtain any information and data on us/me. |
| viii. | DKSH Malaysia Sdn Bhd is authorized to disclose any information and/or data relating to the Company/Business individual as DKSH may deem necessary to any third party. |
| ix. | DKSH Malaysia Sdn Bhd reserves to withdraw or cancel the credit granted to you if any legal action and / or proceedings is command or threatens to be command against you |
